Backstory

After investigating a reported sexual assault of a co-worker in October 2022, the Nebraska State Patrol in Humboldt arrested James Cherry, a 33-year-old employee at Tecumseh State Correctional Institution (TSCI), on January 30, 2023, on suspicion of sexual assault. According to Nebraska Department of Correctional Services, TSCI is a maximum/medium custody facility for adult males. 

Authorities took Cherry into custody on suspicion of first-degree sexual assault and third-degree sexual assault. Johnson County Jail was holding him. In a news release, a 19-year-old corporal reported to a Nebraska State Patrol investigator that Cherry allegedly grabbed and kissed her.

Since Cherry was her supervisor, she was reluctant to report the “unwanted and unprovoked” contact. The arrest affidavit notes the woman reported Cherry’s ongoing actions, accusing him of forcibly placing his hand into her pants.

The affidavit additionally states that Cherry denied the allegations.
