Newark Mayor Ras Baraka Charge Dismissed: What Happened at Delaney Hall

Federal prosecutors dropped the trespassing charge against Newark Mayor Ras Baraka in May 2025, less than two weeks after he was arrested outside the Delaney Hall immigration detention center. The judge on the case used the dismissal hearing to sharply criticize the U.S. Attorney’s Office.

The arrest at Delaney Hall

Baraka was arrested on May 9, 2025, outside Delaney Hall, a privately run immigration detention facility in Newark, while members of Congress were there for an oversight visit. He was charged with trespassing. Rep. LaMonica McIver of New Jersey was later charged by federal prosecutors over a scuffle with officers during the arrest.

Why the charge was dropped

Interim U.S. Attorney for New Jersey Alina Habba announced that her office was dropping the case. Prosecutors said they had conducted a thorough investigation and decided to dismiss the charge to “move forward.”

The judge’s rebuke

On May 21, 2025, U.S. Magistrate Judge Andre Espinosa said he would dismiss the case and spent several minutes reprimanding prosecutors. He called the reversal “embarrassing,” said an arrest “is not a preliminary investigative tool,” and reminded the office that prosecutors serve justice, not political agendas. He also said he learned of the dismissal from news reports rather than from the government.

Baraka’s lawsuit

Baraka later sued Habba, claiming false arrest, malicious prosecution and defamation. A federal judge, U.S. District Judge Brian Martinotti, dismissed that lawsuit without prejudice, ruling that Habba’s statements fell within the scope of her job and that the false arrest claims could not proceed under existing law. Baraka was given time to file an amended complaint.

The case became a flashpoint in the fight over immigration detention in New Jersey and raised questions about the use of arrests against elected officials who seek to inspect federal facilities.
